The Data Controller is Wittchen S.A. with its registered office in Palmiry, at ul. Gdańska 60, 05-152 Czosnów (the "Company"). Personal data will be processed: (i) for the purpose of registration and the operation of the account registered on the website www.wittchen.com – pursuant to the Art. 6 sec. 1(a) and (f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("GDPR"), (ii) for the purpose of accepting and processing orders for the Company's products – pursuant to Art. 6 sec. 1(b) and (f) of the GDPR, (iii) for marketing purposes and for the reminder of an abandoned shopping cart – implemented on the basis of Art. 6 sec. 1(a) and (f) of the GDPR, (iv) for the purpose of concluding and performing , inter alia, a contract for the purchase and sale of the Company's products and/or a contract for the provision of a newsletter service – pursuant to Art. 6 sec. 1(b) of the GDPR and (v) for the purpose of defending, recognising or asserting possible claims by the Customer – pursuant to Art. 6 sec. 1(f) of the GDPR, as well as (vi) for the purpose of dealing with a complaint – pursuant to Art. 6 sec. 1(f) of the GDPR. The aforementioned personal data may be disclosed to the Company's employees and/or collaborators obliged to comply with the applicable legislation, as well as to entities collaborating with the Company on the basis of outsourced services, whereby such entities process the data as subcontractors, exclusively on the basis of an entrustment and/or data sharing agreement concluded with the Company and in accordance with its instructions. In addition, personal data may be disclosed to entities authorised under applicable law. After giving the appropriate voluntary consent, the data may also be made available to ,among others, the following entities: (i) Ceneo Sp. z o.o., (ii) Krajowy Rejestr Opinii S.A, including in particular "Trusted Opinions" on the Ceneo website and "Confirmed Opinions" on the TrustMate website for the purpose of sending (electronically) customer satisfaction surveys, and (iii) entities conducting marketing campaigns for the Controller. Personal data will be processed until the statute of limitations for possible claims, including after deletion of the account registered at www.wittchen.com, and in the case of marketing activities until the voluntarily given consent is withdrawn. In the case of the purchase of a product(s) via the www.wittchen.com online shop, the data relating to the receipt/VAT invoice will be processed until the expiration of the statute of limitations on tax liability and/or until any claims and/or warranty expire and/or in accordance with tax and accounting regulations. If a complaint is made, the data will be transmitted until the complaint is resolved, until an objection is lodged or the claim, if any, expires. Every data subject has the right (depending on the purpose of the processing) to: (i) access and rectify their data, (ii) erasure of their data, (iii) restriction of processing, (iv) data portability, (v) objection to processing, and (vi) the moment of withdrawal of consent – without affecting the lawfulness of the processing carried out prior to the exercise of the aforementioned right. In order to exercise the above-mentioned rights, please contact the Controller in writing at the registered office address of Wittchen S.A. (with the note "do Administratora Danych Osobowych"/"to the Data Controller") or electronically via the e-mail box: ado@wittchen.com. In addition, the data subject has the right to lodge a complaint with the President of the Data Protection Authority if they consider that the processing of their personal data violates the provisions of the GDPR. The provision of personal data is voluntary, but necessary for the above purposes.
