TERMS AND CONDITIONS OF THE NEWSLETTER DISCOUNT CODE

§1 PURPOSE OF THE TERMS AND CONDITIONS

The purpose of these Terms and Conditions (hereinafter: "Terms and Conditions") is to define the rules for receiving and using a discount code within the scope of concluding a Newsletter service agreement.

§2 DEFINED TERMS

the User - means an individual, legal person or organisational unit which is not a legal person and to which the law grants legal capacity, that concludes an agreement with the Organiser for the provision of the Newsletter service in accordance with the Newsletter service Terms and Conditions available at: TERMS AND CONDITIONS OF THE NEWSLETTER DISCOUNT CODE

Discount Code - a one-off discount code in the form of a sequence of digits and/or letters, granted in accordance with the Terms and Conditions specified herein, which entitles the User to make an Order for WITTCHEN brand products with the granted Discount – under the conditions specified herein – received at the moment of concluding the Newsletter service contract

Discount - a one-off discount of PLN 50 gross, received together with a Discount Code at the time of concluding a contract for the Newsletter service;

Newsletter - a collection of information sent by the Organiser to the electronic mail address provided by the User, with a specified frequency, containing informational, promotional, marketing and/or advertising content of the Organiser and/or of the goods or services offered by the Organiser, in particular commercial information, after the conclusion by the Organiser with the User of an agreement for the provision of the Newsletter service in accordance with the Newsletter service Terms and Conditions available at: TERMS AND CONDITIONS OF THE NEWSLETTER DISCOUNT CODE

Online Shop - WITTCHEN online shop available at: www.wittchen.com, offering the possibility of conducting sales and making purchases via the Internet;

Organiser - WITTCHEN Spółka Akcyjna with its registered office in Warsaw, ul. Gdańska 60, 05-152 Czosnów, entered into the National Court Register kept by the District Court for the capital city of Warsaw, XIV Commercial Division of the National Court Register under KRS number: 0000352760, NIP: 9511022154, REGON: 011664266;

Products - all goods offered by the Organiser in the Online Shop

Order – a declaration of will of the User submitted via the Online Shop, from which stems the will to conclude a sales agreement, in particular using the functionality of the Online Shop, submitted with the use of means of remote communication, including data necessary for the conclusion and execution of the agreement, in particular specifying the type and quantity of Products, price, type of delivery, type of payment, place of delivery of the goods and personal and other data of the User.

§3 CONDITIONS FOR GRANTING AND USING THE DISCOUNT

1. The User who has concluded an agreement with the Organiser for the Newsletter service, which is concluded by clicking on the activation link received in the electronic message addressed by the Organiser to the User, shall receive, at the e-mail address provided by the User, a unique, one-time Discount Code entitling the User to receive a Discount for the purchase of Products only in the Organiser's Online Shop. The Organiser shall send the Discount Code to the User's e-mail address provided by the User for the purpose of subscribing to the Newsletter within no more than 2 days after the User has subscribed to the Newsletter.
2. The discount shall be valid for 30 days from the date of its receipt in the email, as per sec. 1 above.
3. The User may use the discount on all Products available in the Online Shop.
4. The gross minimum value of the purchased Products entitling to use the Discount is PLN 350.00.
5. The use of the Discount Code is voluntary and free of charge (apart from the payment of the price of the Products and the costs selected by the User in the Order, including delivery costs) and depends solely on the User's will.
6. The User can only use the Discount once.
7. In order to use a Discount Code in the Online Shop, all of the following requirements must be met:
1. 1) the User needs to conclude an agreement for the Newsletter service and acquaint themselves with the Newsletter regulations, these Terms and Conditions and the Privacy Policy of the Online Shop under the following link: https://www.wittchen.com/en-US/polityka-prywatnosci
2. 2) receive a Discount Code
3. 3) make an Order of Products for a gross amount of PLN 350.00 or more;
4. 4) before placing the Order – in the shopping cart section – enter in a dedicated space the Discount Code received in the email from the Organiser;
5. 5) place an Order in accordance with the provisions of the Terms and Conditions of the Online Shop available at: https://www.wittchen.com/en-US/regulamin
8. The Discount Code is not exchangeable for a cash equivalent or any other service provided by the Organiser.

Products purchased by the Participant using the Discount are subject to the general terms and conditions for withdrawal from a distance contract and the lodging of a complaint under the Terms and Conditions set out in the rules of the Online Shop available at: https://www.wittchen.com/en-US/regulamin
10. In order to correctly use a Discount Code when placing an Order, the User should enter their Discount Code in the "Use Discount Code" field (or equivalent button) and then confirm the steps above when placing the Order.
11. The correct use of a Discount Code under the terms set out above will result in a reduction in the total value of the Products in the shopping cart which were added by the User at the time of placing the Order by the amount of the Discount.
12. When placing an Order, the User is only entitled to use one Discount Code per Order in the Online Shop.
13. In the event that the User returns Products purchased with a Discount Code in the event that the User, who is a consumer, has exercised their right to withdraw from the contract, the value of the received Discount shall not be refunded, and the refund with only amount to the User's own contribution (both as regards the given Product and the entire Order).
14. The Discount does not entitle the User to a reduction in the purchase price of WITTCHEN gift cards.
15. The Discount does not entitle to a reduction in the purchase price of Products the price of which has already been reduced via the use of another discount code.
16. The Organiser is entitled to terminate the issue of Discount Codes at any time.
17. The Organiser shall not be liable for the consequences of incorrect or false data provided by the User or for entering the wrong Discount Code at the time of placing an Order.
18. If in doubt about the Discount Codes, the User may contact the BOK.

§4 COMPLAINT PROCEDURE

1. Users should submit any complaints regarding the Discount Code in writing to the Organiser's registered office address, with the annotation: "Complaint – Newsletter Discount Code".
2. Complaints must be sent by registered letter with notice of receipt. The complaint should include: name, exact mailing address, e-mail address, as well as a detailed description and justification of the complaint.
3. Complaints will be considered on the basis of these Terms and Conditions within 14 days from the date of receipt. The person making the complaint will receive the decision in writing at the postal address provided by the User in the complaint or electronically in an e-mail message if the User has indicated an e-mail address in the content of the complaint as the means for sending the complaint decision.
4. A User who is a consumer may, in matters relating to Discount Codes, make use of out-of-court methods for the handling of complaints and the assertion of claims.

§5 FINAL PROVISIONS

1. The Terms and Conditions are subject to change in the following cases:
1. 1) a change in the legal provisions governing the terms, conditions and organisation of the Discount, affecting the mutual rights and obligations of the Organiser and the Users
2. 2) a change in the provisions of law governing the sale of Products or provision of services by electronic means by the Organiser affecting the mutual rights and obligations set out in these Terms and Conditions or a change in the interpretation of the aforementioned provisions of law as a result of court rulings, decisions, recommendations or recommendations of authorities or entities competent in a given field
3. 3) change of the Discount granting procedure due to technical or technological reasons;
4. 4) a change in the scope of the provision of services to which the provisions of the Terms and Conditions apply, through the introduction of new, modification or withdrawal of existing functionalities or services specified in the Terms and Conditions by the Organiser.
2. If the Organiser makes significant changes to the Terms and Conditions to the extent referred to in sec. 1 above, then the Organizer shall make the consolidated text of the new Terms and Conditions available on the Website and by means of a message sent to the e-mail address provided by the User when subscribing to the Newsletter service.
3. The amendment to the Terms and Conditions shall take effect 14 days from the date of dispatch of the notice of amendment.
4. These Terms and Conditions do not restrict the rights of the User, including a User with the status of a consumer or entrepreneur, to whom the provisions of the law on consumer rights apply, and to which they are entitled under the laws in force in the territory of the Republic of Poland. If a provision of the Terms and Conditions of this nature is found to exist, the provisions of the applicable law shall apply unconditionally.
5. The Agreement is concluded in Polish.
6. Any rights not regulated by these Terms and Conditions shall be governed by the applicable provisions of Polish law.
